Overview

These Terms of Service ("Terms") govern your use of the DestinationAGo OSM Business Listing Service ("Service"), operated by DestinationAGo ("we," "us," or "our"). By submitting a listing request and completing payment, you agree to be bound by these Terms.

Service Description

The Service provides a one-time, $25.00 USD listing submission to OpenStreetMap (OSM), making your business discoverable to travelers using the DestinationAGo app. The Service includes:

• Manual review and submission of your business data to OpenStreetMap
• Email confirmation once the listing has been added
• Discoverability within the DestinationAGo app upon OSM indexing

The Service does not guarantee search ranking, placement priority, or visibility beyond standard OSM data propagation. OSM is an independent open-data platform and DestinationAGo does not control its indexing timelines.

OpenStreetMap — Open Data Acknowledgment

You confirm that you have the authority to submit this business information for public listing and that doing so does not violate any third-party rights or applicable laws.

Payment Terms

• The listing fee is a one-time, non-subscription payment of $25.00 USD
• All payments are processed securely via Stripe
• Payment is due at the time of listing submission
• Stripe's processing fees from the original transaction are non-refundable
• Refunds are subject to the terms of our Refund Policy

Your Responsibilities

By submitting a listing, you represent and warrant that:

• You are the owner, operator, or authorized representative of the business being listed
• All submitted business information (name, address, category, phone, website) is accurate, current, and complete
• The business is a legitimate, operating business at the address provided
• The selected business category accurately reflects the nature of your business
• You will notify us of any material changes to your business information after submission by contacting destinationago@destinationago.com

Submissions containing inaccurate, false, or misleading information are ineligible for refund and may be removed from OpenStreetMap.

Our Responsibilities

DestinationAGo agrees to:

• Review your submission within 1 business day of confirmed payment
• Submit accurate, verified data to OpenStreetMap in good faith
• Send an email confirmation once your listing has been added to OpenStreetMap
• Respond to refund requests and inquiries within 3 business days

Intellectual Property

All DestinationAGo branding, app content, design, and code are the exclusive property of DestinationAGo and may not be reproduced, distributed, or modified without prior written consent.

Business data submitted through the Service becomes part of the OpenStreetMap public dataset under the Open Database License (ODbL) and is no longer under the exclusive control of DestinationAGo or the submitting party once published.

Limitation of Liability

To the maximum extent permitted by applicable law, DestinationAGo's total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid for the Service ($25.00 USD).

DestinationAGo is not liable for:

• OpenStreetMap downtime, data propagation delays, or indexing decisions
• Third-party search engine behavior or app discoverability beyond OSM data
• Loss of business, revenue, or reputation resulting from listing errors or omissions
• Inaccuracies in listings caused by information submitted by the customer

Disputes & Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Massachusetts.

Before initiating any legal action or chargeback, you agree to contact us directly at destinationago@destinationago.com to attempt good-faith resolution. See our Refund Policy for details on chargebacks and disputes.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via email where applicable.
